Dilapidation break option to a negotiated lease surrender, 2020
Acting for Brainwave Children’s Charity, we were able to negotiate agreeable lease surrender terms, rather than rely on compliance with an onerous conditional break clause.
Through negotiation with the Landlord’s representative, and responding in accordance with RICS dilapidation protocol, we avoided reliance on the break clause and agreed a lease surrender, subject to a small cash settlement and completion of a significantly reduced scope of works.
We successfully reduced the Landlord’s dilapidation claim by more than 70%.
Rather than invoice our usual fee, we were proud to offer our dilapidation expertise pro bono, using our skill to support the charity and the incredible job they do in supporting children and families.
